2. No warranty or representation is made that the service will: meet your particular requirements; be uninterrupted, timely, secure, or error-free; nor that it will meet your expectations.

3. No advice or information, whether oral or written, obtained by you from this service shall in any way create any warranty or other obligation not expressly stated in these terms and conditions.

Registration and any other data or information obtained through the provision of this service will be held private and secure and subject to the confidentiality terms outlined in my code of ethics. Both this privacy and this security shall be reasonable as to the service as described only. No information given by any user at any time will require any higher degree of security or privacy than that generally available during a standard public telephone call. Data will be stored on my local computer, and on third-party servers that enable this service to be provided. Data stored locally is protected by a screensaver password. SSL encryption is not provided. In accordance with item 7 below no liability is accepted for any disclosure caused by unauthorised access to your data.

The provision of links to other web sites or to material not under my control in no manner indicates any responsibility for the availability of such external sites or resources, and does not endorse nor assume any liability whatsoever for any content, advertising, products, or other materials on or available from such sites or resources. In no manner do I accept any responsibility or liability, directly or indirectly, for any damage or loss caused or alleged to have been caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such site or resource.

This service and any information presented to you through this site contains proprietary information that may be protected by copyrights, trademarks, service marks or other proprietary rights and laws, as well as applicable intellectual property and other laws. Except as expressly authorised you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on phoenix change coaching in whole or in part.

To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from my negligence, no liability is accepted for any claims, loss, demands or damages of any kind whatsoever with respect to this service, and any information, content, advertisements or products provided or distributed through it including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to me previously. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.

8. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. These terms and conditions and the relationship between you and I shall be governed by the laws of England and you agree to submit to the exclusive jurisdiction of the English courts. Any failure by me to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties' intentions as reflected in the provision, and that all other provisions in these terms and conditions shall remain in full force and effect notwhithstanding the outcome of such decision.
